Intanto ormai sono divenuti quattro i dipendenti seguiti dalla Clinica del Lavoro: tutti dipendenti nello stesso carcere, tutte donne.
Ma neanche durante la malattia a Filomena è permesso di vivere in pace e così i suoi superiori inviano il suo certificato medico alla Motorizzazione perché provveda alla revisione della patente senza che nessun medico abbia determinato la perdita dei requisiti alla guida.
A questo punto è infatti la Uil a farsi carico della sua denuncia scrivendo a tutti i responsabili che il “04/03/02 vengono richieste revisioni delle personali patenti di guida inviando “disinvoltamente” certificazioni medica mediante fax alla motorizzazione civile, privi del consenso scritto dell’interessato. La disinvoltura che distingue la prassi adottata nella Casa Circondariale di Bologna è ancor più lesiva poiché viene adottata con ampia discrezionalità solo verso alcuni dipendenti, in alcuni casi addirittura reiterandola.”.
Si avviano numerosi contenziosi civili riferiti a questa prassi illegittima per i quali, il 21 novembre di quest’anno, nell’ultima udienza al Tar, due sue colleghe hanno testimoniato che per la stessa malattia non era stato chiesto loro alcun certificato per la revoca della patente.
“Aver rotto il patto del silenzio” - mi racconta Filomena - “questa è stata la mia grande colpa. Nei periodi in cui rientravo al lavoro, durante la malattia, i superiori mi davano continuamente della pazza e della bugiarda o inventavano storie su di me, ma alcuni colleghi mi hanno sempre creduta. Questa è la cosa più bella di tutta la vicenda, ma anche la più triste, perché hanno iniziato a punire anche molti di loro.”.
Ormai si è giunti all’uso dei procedimenti disciplinari per “rieducarla”. Ogni mese, per cinque mesi le viene fatto un rapporto disciplinare, l’unico sostegno spesso per Filomena è la collaborazione e la stima che riceve da alcuni suoi colleghi, ed è questo che le da la forza di andare avanti.
Passa un altro anno, il settimo. E’ il 2005 quando Filomena rientra definitivamente dalla malattia. Sebbene sia ancora una donna giovane e possegga un ottimo curriculum, i suoi superiori le chiedono di andare in pensione. Il messaggio è chiaro, Filomena deve essere isolata.
Ancora una lotta.
